- Profiling
Personal Data Enrichment
To have a better overall understanding of you as a customer, we may combine information about you gathered across various channels. For example, Personal Data collected in the course of your online activity (e.g. shopping, account creation, etc.) may be combined with Personal Data we collect when you visit one of our Points of Sale or Communications to provide personalised services, content, targeted communications and advertising and for analytics purposes.
This Personal Data enrichment may also occur between different brands of the Orveon Group (and across different Orveon Group companies). For example, if you make an online purchase on the Laura Mercier website and then create an online account with the same email address on the website of another Orveon Group brand (e.g., bareMinerals or BUXOM), the Personal Data collected through these two websites may be combined to enrich your customer profile. This helps us to propose products and advice that is most relevant to your interests at particular times, by email (where we have your consent) or when you visit one of our Points of Sale. We may also draw inferences from your information and interactions with us to enrich and supplement your profile, such as inferences about your product preferences or price sensitivity based on your purchase history.
Fraud monitoring
In addition to internal fraud monitoring operations, Orveon uses third party software for the purposes of fraud monitoring, which may use artificial intelligence-powered algorithms to identify patterns that may indicate fraudulent or unsafe behaviour, such as those which vary significantly from typical user behaviour. To do this, the third party software may perform real-time monitoring of information collected from or generated by users, including information relating to your use of our Sites, and Payment and Transaction-related information.
If automated systems of the third party software detect potential fraudulent or activity, they may restrict your access to our services.
You can object to these “profiling” operations at any time by contacting us using the details below. Please refer to the “Your rights and choices” section for more information.
If you fail to provide your Personal Data
Where we need to collect your Personal Data by law or under the terms of a contract we have with you and you fail to provide that Personal Data when requested, we may not be able to perform the contract we have or are trying to enter into with you. In this case, we may have to cancel a product or service you have through us but we will notify you if this is the case at the time.
- With whom do we share your Personal Data?
- Other members of the Orveon Group: your Personal Data may be shared with the other members of the Orveon Group who are involved in our customer relationship management. Your data may also be shared with other brands of the Orveon Group to enrich your customer profile and update your Personal Data. We do so to build a central record, keep the information we hold about you up to date (for example, you may be a customer of more than one of our brands), tailor our communications with you, fulfil your orders, respond to your inquiries or to run analytics and perform statistics.
We may also share information that has been anonymised or aggregated without limitation.
-
Third party vendors and providers: your Personal Data may be accessible to selected third-party vendors or providers for the needs of the purposes described above in section 4. For example, our transporters will need to access your Personal Data to deliver the products you ordered, our e-commerce support, advertising and marketing campaign providers will need to access your Personal Data to send you the relevant communications, our IT service providers might need to access your Personal Data in order to provide us with web hosting and platform management services. Separately, we may also share your Personal Data with security service providers to detect, investigate, monitor, remediate and/or prevent fraud, security incidents or other unlawful activity in connection with your transactions and use of our websites, apps and services; and with payment service providers whenever you purchase our products to facilitate the processing of payments you make. In addition, we may share your Personal Data with third parties where we have your permission to do so (e.g. social network providers, our authorised retail partners or e-commerce platforms that sell our products).
In any case, we require such third parties to: - be subject to strict contractual data protection and confidentiality obligations; undertake to comply with all applicable data protection laws and, where applicable, exclusively in accordance with our instructions and for the purposes specified in the contract we have with them;
- implement appropriate technical and organizational security measures designed to protect the integrity and confidentiality of your Personal Data.
- Third party advisors: we may need to share your Personal Data with any third party advisors including accountants, tax advisors, forensic services (where applicable in the event of a personal data breach), legal advisors where such advice is required.
- Law enforcement and regulatory authorities: we might need to share your Personal Data with relevant regulatory, government authorities, courts or tribunals when the law requires us to do so or where it is necessary for the establishment, exercise or defence of legal claims, or to protect the rights, property or safety of the Orveon group, our customers or others. For instance, we might be requested to provide invoices to tax or financial authorities, or to provide information related to adverse events linked to the use of our products to authorities, or in the event of litigation.
- Other purposes: we might need to share your Personal Data to other parties:
- If we sell any or part of our business or assets, to the prospective buyer of such business or assets. Your Personal Data will usually be processed by the buyer acting as the new controller and its privacy policy will govern the processing of your Personal Data; and/or
- In other circumstances if we have your consent or we are permitted to do so by law.
- Where may we transfer your Personal Data?
Orveon is a multinational organisation with affiliates, vendors and partners located in many countries around the world. For that reason, we may need to share your Personal Data with entities located in jurisdictions outside the UK and EEA, including to the United States, where Orveon Global US LLC is based. Some of these jurisdictions may not be regarded as providing the same level of protection as yours.
In all cases, we ensure that appropriate safeguards, as required under the applicable data protection laws, are in place. Such safeguards may include:
- adequacy decisions issued by the European Commission (with respect to transfers out of the EEA) or the UK Government (with respect to transfers out of the UK) that determine the data protection legislation in the recipient jurisdiction provides an ‘adequate’ level of protection for personal data;
- EU Standard Contractual Clauses approved by the EU Commission (with respect to transfers out of the EEA) or the UK International Data Transfer Addendum to the EU Standard Contractual Clauses approved by the UK Government (with respect to transfers out of the UK); or
- our providers’ Binding Corporate Rules (often known as ‘BCRs’).
For more information about the transfer of your Personal Data, you can contact our Personal Data Protection Officer using the contact details below.
- How long do we retain your Personal Data?
We will retain your Personal Data for the period necessary to fulfil the purposes outlined in this Policy (see section 4).
The criteria used to determine such retention periods include:
- the length of time we have an ongoing relationship with you;
- whether there is a legal obligation to which we are subject imposing on or authorising us to keep your Personal Data.
- whether a longer retention period is required or permitted by law.
Where we process personal data for marketing purposes or with your consent, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests). We also keep a record of the fact that you have asked us not to send you direct marketing or to process your data indefinitely so that we can respect your request in future.
Where your Personal Data are collected by cookies or similar technologies, please see our Cookie Policy for further information on relevant retention periods.

- The right to correction of your Personal Data if they are incomplete or inaccurate;
- The right to erasure of your Personal Data, in certain circumstances;

- The right to object to the use of your Personal Data where our “lawful basis” is our legitimate interests (or those of a third party), including processing for direct marketing purposes or profiling for purposes of direct marketing. - The right to restrict use of your Personal Data, in certain circumstances; and/or
- The right to “data portability”. This enables you to request us to transmit personal data that you have provided to us, to a third party without hindrance, or to give you a copy of it so that you can transmit it to a third party, where technically feasible.
Where a decision is made solely by automated processing that legally or significantly affects you (for example, rejecting a sign up or cancelling a delivery on fraud grounds), you can request human review, express your point of view and contest the decision by using the contact details below.
Additionally, if you live in France, you may also have the right to instruct us on the processing (retention, deletion, and disclosure) of your Personal Data after your death. You can change or revoke such instructions at any time.
Where permitted by law, note that we may need to request additional information from you to verify your identity or understand the scope of your request.
In addition, these rights may be limited, for example if fulfilling your request would reveal personal data about another person or if you ask us to delete information which we are required by law to keep.
If you wish to exercise any of these rights, please contact us at the contact details set out below.
In some cases, we are also able to send you direct marketing without your consent, where we rely on our legitimate interests.
